Webdesign Rip-off?

Did an author rip-off the design of their web site from a Pinoy webdesigner?

The design of the ex-client is, according to Filipino web designer Gail Dela Cruz, based on her original concept. You'll find the screenshots at This isn't the way to get rich.

Apparently, the design was made, but the customer asked for a refund. After the refund was given, the customer still used the design.

I wonder if the customer will air his side of the story on his blog. Wait... does he have one?
